Law Enforcement Officer Detained by Immigration Officials During Airport Travel

A Wisconsin state patrol trooper found himself in handcuffs this week after being detained by Immigration and Customs Enforcement agents at a regional airport. Carel Aaron Van Der Merwe, a twenty one year old officer originally from South Africa, was waiting to board a domestic flight at the Dane County Regional Airport when he was apprehended as part of what officials described as a targeted enforcement operation. According to his legal team, Van Der Merwe attempted to inform agents that he possessed a valid federal work authorization and a pending asylum application, but those claims were ignored as he was shackled and transported to a detention center in Juneau.

Government officials have defended the move, stating that neither a pending application nor work authorization grants an individual permanent legal status within the United States. A spokesperson for the Department of Homeland Security explained that while Van Der Merwe entered the country legally in early 2019, he overstayed his permitted stay several months later. The agency emphasized its commitment to ensuring that individuals residing in the country illegally cannot utilize domestic flights, asserting that such actions are necessary for upholding national law.

Attorneys representing the young trooper have condemned the arrest as inhumane and unnecessary, pointing out that Van Der Merwe has served as a trusted member of the state patrol for nearly a year. His lawyer, Marc Christopher, argued that removing an active duty officer who is already vetted by the state does little to improve public safety and instead creates undue hardship for both the family and the community. As it stands, Van Der Merwe remains in custody awaiting further removal proceedings while his lawyers demand an explanation from federal authorities.
